Acceptance of these terms
These Terms of Service (the “Terms”) are an agreement between you and Qalab Hassnain Agha, the individual developer of Apex Rider, based in Pakistan (“Apex Rider”, “we”, “us”). By downloading, accessing or using the Apex Rider app or website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Apex Rider.
Licence to use the app
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Apex Rider on devices you own or control, for your own non-commercial motorcycle touring use. You may not copy, modify, reverse-engineer, resell or sublicense the app except as permitted by law.
Accounts & eligibility
You must be at least 16 years old in the EEA and the UK, and at least 13 years old elsewhere, to use Apex Rider, and old enough to ride lawfully where you live. If you are under the age of majority in your jurisdiction, you may use Apex Rider only with the consent and supervision of a parent or legal guardian. You can use the core ride features without an account. If you create an account for the community layer or cross-device sync, you are responsible for keeping your credentials secure and for activity under your account. You can delete your account at any time — see Delete your account & data.
Safety, crash detection & SOS
Ride safely. Apex Rider is an aid, not a substitute for safe riding and your own judgement. Do not operate the app or look at your device while riding — set up your route and settings before you ride, and use voice guidance and glance-only controls. Obey all traffic laws and ride within your limits and conditions.
No guarantee. Maps, routes, navigation, weather, and points of interest may be inaccurate, incomplete, or unavailable (including offline or with no GPS signal). Crash detection and SOS are best-effort and may fail to detect an incident or to send an alert (e.g. no signal, no battery, sensor limits). Never rely on them as your only means of getting help. Live location sharing depends on connectivity. You are responsible for carrying appropriate safety and emergency equipment.
You are solely responsible for your riding, for obeying all traffic and safety laws, and for deciding whether conditions are safe. Apex Rider does not control your vehicle and cannot summon a guaranteed rescue, and is not a replacement for emergency services, a satellite messenger, or proper riding gear. Always carry appropriate backup for remote travel.
Your content & community
Rides, photos, routes and road reports you create remain yours. By posting content to the community, you grant Apex Rider a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content for the purpose of operating and promoting the service, including showing it to other riders. You are responsible for the content you post and must have the rights to share it.
Zero tolerance for objectionable content and abusive users. You must follow our Community Guidelines whenever you use community features (profiles, posts, comments, chat, direct messages, crews and crowd-sourced places). There is no tolerance for objectionable content or abusive behaviour. You can report any content or profile in-app and block any rider. We review reports and remove violating content and offending accounts, typically within 24 hours, and may restrict features or permanently terminate accounts that violate the Guidelines. Apple's standard Licensed Application End User License Agreement (EULA) also applies to the app, in addition to these Terms.
Acceptable use & Community Guidelines
You agree not to misuse Apex Rider — including by breaking the law, infringing others' rights, attempting to disrupt or reverse-engineer the service, scraping or bulk-extracting data, harvesting other users' data, impersonating others, sharing another rider's location without consent, or using the safety features to make false reports. You must also comply with our Community Guidelines at all times. We may remove content and suspend or terminate access for violations.
App stores (Apple & Google)
You obtain Apex Rider through the Apple App Store or Google Play and agree to the applicable store terms. For iOS, Apple's standard Licensed Application End User License Agreement applies in addition to these Terms (and these Terms prevail where permitted). You acknowledge that: this agreement is between you and Apex Rider, not Apple or Google; the store provider has no obligation to provide support or maintenance for the app; and, for iOS, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them, the licence is limited to use on Apple-branded devices you own or control, and Apple is not responsible for any product claims, warranties, or legal claims relating to the app.
Intellectual property
Apex Rider, its name, logo, software, design and content (excluding your content and third-party data) are owned by us or our licensors and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.
Disclaimers
To the maximum extent permitted by law, Apex Rider is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that navigation, weather or safety features will always be accurate or available.
Limitation of liability
To the maximum extent permitted by law, Apex Rider and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of (or inability to use) the app, reliance on its navigation or safety features, or any incident while riding. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by our negligence where applicable). Where liability cannot be excluded, it is limited to the amount you paid for the app in the 12 months before the claim, or the minimum permitted by law.
Termination
You may stop using Apex Rider and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the service or other riders. Sections that by their nature should survive (including content licence, disclaimers, and limitation of liability) survive termination.
Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws rules, and disputes will be handled by the courts of Pakistan, except where mandatory local consumer law gives you other rights.
Changes to these terms
We may update these Terms as the app evolves. We will revise the “Last updated” date above and, for material changes, give more prominent notice. Continued use after an update means you accept the revised Terms.
